On May 7, 2014 the Employment & Labor Practice in Kaye Scholer’s Frankfurt office will host a breakfast seminar on “The Protection of Know-How in the Employment Relationship.”

A company’s success is significantly influenced by how it responds to innovations in products and technologies, as well as customers’ special needs. These are what sustain the company’s position in the market and create benefits and enduring competitive advantages. Employees represent the know-how of the company, but they can also be considered a vulnerability with respect to breaches of confidentiality obligations or potential anticompetitive practices. Furthermore, employees’ inventions have to be protected if the company is to thrive.
