Healthcare

For decades, Arnold & Porter has been a leader in helping entities involved in the provision and facilitation of health care to innovate successfully, while anticipating and responding to complex regulatory and compliance challenges in the U.S. and Europe. We assist our clients as they think through the opportunities and risks inherent to new business ventures. We resolve their issues and concerns and support the advancement of key business operations. Through an integrated approach, combining our years of industry experience and service in high-ranking government positions, such as the Center for Medicare and Medicaid Services (CMS), the U.S. Food and Drug Administration (FDA), and the U.S. Department of Justice (DOJ), we understand the issues that health care institutions confront, and we have the experience, understanding of the law, and skills to help our health care clients successfully navigate their daily and long-term challenges.

The combined elements of our health care practice that make Arnold & Porter unique are:

Full range of practices serving health care clients. The firm offers corporate, regulatory, transactional, litigation, and intellectual property capabilities for all types of health care industry clients. This practice incorporates data privacy and security proficiency (including HIPAA, FISMA, FACTA, state data security breach laws, software vulnerabilities, and software liability).

Practice integration. Our health care practice is not siloed — our attorneys work closely together across practice areas to serve our clients. For example, if appropriate for a given matter, lawyers from our government contracts, litigation, and regulatory practice groups may form a team to provide the most cost-effective representation for the client.

Deep industry knowledge. Our team of highly skilled attorneys and senior professionals includes the former Deputy Director of the Medicare fee-for-service program, a former Medicare carrier medical director, a former Congressman, the former Deputy Chief of the Fraud Section of DOJ in charge of health care fraud, and a nurse practitioner.

Long-term constructive relationships with regulators. We understand how regulators and enforcement officials think and what it takes to advocate for clients in a manner that builds a constructive relationship with the government. This knowledge extends to officials across HHS (including CMS and FDA) and other regulatory agencies affecting the health care industry.

Global practice. Our U.S. attorneys share many clients with the life sciences practitioners in our London office. That group also includes former government officials and works regularly on matters in various jurisdictions around the world, directly and with the support of a closely associated network of local expert correspondence counsel.

Through interdisciplinary collaboration and deep and specialized experience, Arnold & Porter offers truly innovative and effective solutions that align with client business objectives in the health care sector.
