International Procurement

Our practice includes broad experience advising US and international companies on US laws, the Trade Agreements Act, the Government Procurement Code, foreign military sales, and other statutes and regulations that govern contracting with governments and sourcing beyond national boundaries.  In addition, we represent and counsel clients on compliance with the complexities of the Foreign Corrupt Practices Act (FCPA), including conducting internal FCPA investigations, representing clients before the Securities and Exchange Commission and the Department of Justice in connection with government enforcement investigations, and formulating FCPA compliance programs.  We assist government contracts clients faced with allegations of improper payments to foreign officials and conduct investigations into allegations of corruption with respect to foreign government contracts.

We also advise clients with respect to the related Convention adopted in 1998 by the Organization for Economic Cooperation and Development (OECD)-the Convention on Combating Bribery of Foreign Public Officials in International Business Transactions.  We counsel clients with respect to the US antiboycott regulations, which prohibit support for entities engaged in boycotts of specific countries.  Our lawyers also assist US and multinational corporations that wish to take preventative steps to deal with these complex regulatory regimes, including the development of compliance programs, the training of appropriate personnel, and the implementation of procedures to ensure that personnel worldwide adhere to applicable FCPA, OECD, and antiboycott rules.
