Leniency Program Under German and European Antitrust Law Not Waterproof Any More

Associate Jens Steger wrote an article for the prominent German Stock Exchange newspaper, Börsen-Zeitung, in which he summarized the latest developments related to antitrust leniency applications under German and European law. The decision is relevant for the implementation or update of an antitrust compliance-system, especially if the question arises of whether to make use of the possibility of an antitrust leniency-application under German and/or European antitrust law. On the other hand, the decision should also be kept in mind by potential claimants considering antitrust private enforcement actions against former cartel members, as it delivers new possibilities for antitrust claims under German and European law.
