“Made in USA” is among the most popular advertising claims for product manufacturers and consumers alike. But the term is highly regulated under both federal and state law and can have complicated interactions with other regulatory requirements. Recently, the Federal Trade Commission (FTC), local District Attorneys, and the private plaintiff’s bar have all brought enforcement actions. California’s restrictive statute was amended in January to provide a quantitative standard, and a further amendment is under review.
