Liability for Releases of Oil & Gas in Colorado: CURRENT TRENDS AND DEVELOPMENTS

The recent, historic flooding in Colorado led to over 40 releases of oil, gas, and produced water that are currently being tracked by the Colorado Oil & Gas Conservation Commission. Recent developments and trends in Natural Resource Damage (NRD) cases under the Oil Pollution Act and CERCLA, and also claims under the Clean Water Act (CWA), present important considerations and challenges to oil & gas companies facing current or future releases.

This presentation will provide an overview of liability under federal statutes and toxic tort law, including how government claimants are using the federal NRD framework to attempt to leverage additional concessions beyond standard cleanup and remediation costs, and new developments in the enforcement of the CWA and its application to inland waters. We will provide an overview of the statutes and regulations at issue, defenses, processes and key issues your company should be prepared to address.
