Frank McCay concentrates his practice on real estate finance, in particular the representation of portfolio lenders in the origination, syndication, workout and restructuring of construction, acquisition, permanent mortgage, mezzanine and other secured and unsecured financings and related intercreditor matters.  Assets involved have included retail, residential, office and hotel properties throughout the United States.

 

Experience

  • Represented the agent in a US$450 million syndicated mortgage financing of the retail condominium unit of a hotel on Fifth Avenue in New York.
  • Represented the agent in a US$170 million syndicated construction loan relating to a residential development in downtown Brooklyn, New York.
  • Represented the agent in the origination of a US$375 million syndicated construction loan relating to the redevelopment of an office building in New York’s financial district into a mixed-use hotel, residential and retail project, and the subsequent workout and restructuring of the loan.
  • Represented the agent in the origination of a US$400 million syndicated construction loan relating to the gut renovation of the largest privately-owned office building in Washington, D.C., and the subsequent workout and restructuring of the loan.
  • Represented the agent in a syndicated mortgage/mezzanine financing totaling US$400 million relating to 21 apartment buildings in Manhattan, Brooklyn and Queens, New York.
  • Represented the lender/seller in the transfer to a third-party purchaser in lieu of foreclosure of a residential development in Washington, D.C. as part of a pre-packaged bankruptcy.
