David A. Giroux

David Giroux focuses primarily on pharmaceutical products liability litigation, general commercial litigation, breach of contract actions and FDA regulatory compliance.

Mr. Giroux has experience at all stages of litigation. He has defended major pharmaceutical manufacturers in multiple state and federal failure-to-warn cases, advised clients in commercial and employment contractual matters, and counseled on litigation and regulatory considerations related to proposed acquisitions. Mr. Giroux has also provided regulatory compliance guidance to pharmaceutical manufacturers, particularly related to FDA adverse event reporting requirements and anti-kickback concerns. He recently conducted an internal compliance audit for a major pharmaceutical company.

Mr. Giroux also has an active pro bono practice. He represented state judges challenging a Kansas law that stripped the Kansas Supreme Court of its constitutional authority to administer the state’s unified court system. Mr. Giroux also defended the City of New York against constitutional tort, wrongful death, and medical malpractice claims. In addition, he has represented clients seeking child support modifications and clients seeking Social Security disability benefits. 

Mr. Giroux received his JD from the New York University School of Law. While at NYU Law, Mr. Giroux served as the Symposium Editor for the NYU Annual Survey of American Law, overseeing the journal’s symposium “The Continuing Vitality of Unions.” He also participated in the law school’s Civil Rights Clinic.
